We understand that there is a need for financial assistance for many spouses and for children. Although both child support and spousal support involve the payment of money, they are very different.
Child support is provided for the financial support of your children and may often appear to be a simple calculation, done by punching numbers into a formula. However, it's factors vary and there are exceptions that may apply. An attorney can help you to look at these factors in more detail. We can assist with ensuring that the calculation is correct and that you are not paying too much support, or receiving too little.
Spousal support, formerly called "alimony", is intended to provide financial relief to a former spouse. It is not paid in every divorce. Spousal support is determined in an entirely different manner than child support. It's calculation is very fact specific and there is no set formula for spousal support.

Oregon has a child support guideline that is usually used to calculate support. The amount of child support depends upon the income of each parent, the amount of parenting time that each parent has with the child(ren), day care costs, medical insurance costs, and other factors. Usually, but not always. In certain circumstances, there may be rebuttal factors that would make the child support calculator inappropriate based upon the specific facts of your case. Spousal support was previously known as alimony. There are three types of spousal support: (1) transitional support as needed for training and re-entry into the job market or to prepare for advancement, (2) maintenance support designed to keep a spouse maintained in a comparable standard of living as that enjoyed during the marriage, and (3) compensatory support when there has been significant financial or other contribution by one party to their spouse's education, training, vocational skills, career or earning capacity.
The award of spousal support is very fact specific. It depends upon the length of the marriage, the ages of the parties, the incomes of each spouse, each person's financial needs, their capabilities of being employed and the tax consequences of spousal support, among other factors. Generally, as the length of the marriage increases, spousal support will be ordered for a longer period of time and may be indefinite, although there is no magic formula to tell you how much spousal support you will receive, or exactly how long. Judges have a large amount of discretion in ordering spousal support. However, our attorneys are experienced in family law matters and can give you advice based upon their expertise, prior court awards and trends under Oregon case law.
Both child support and spousal support can be ordered to be paid on a temporary basis while your case is pending. One of our attorneys can assist with obtaining orders for temporary child support, temporary spousal support, or both, if appropriate. A temporary order for support will stay in place until a final judgment is entered.
